DELIVERY OF BALLOON PACKAGES AND GIFT ITEMS

  1. WE PROVIDE BALLOONS FROM A SINGLE FOIL BALLOON TO A FULL EVENT SETUP AND CAN DELIVER THESE TO YOU FOR FREE IN THE CHORLEY AREA IF YOUR ORDER IS OVER £50.  MINIMUM ORDER FOR DELIVERY £25.  DELIVERY PRICES LISTED BELOW.  

    1.1  BUBBLE BALLOONS FOR POSTAL ORDER WITH ANY INFILL WILL BE POSTED ON A 48HR POSTAL SERVICE VIA PARCELFORCE.  YOU MUST BE AVAILABLE TO SIGN FOR YOUR DELIVERY.  PLEASE NOTE THAT WE ONLY DELIVER TO UK MAINLAND, SEE BELOW FOR DELIVERY OPTIONS :

    1.2  DELIVER BY COURIER

    YOUR ORDER WILL HAVE TO BE SIGNED FOR SO PLEASE ENSURE THERE IS SOMEONE AVAILABLE.

    YOU WILL BE ABLE TO SUGGEST A SAFE PLACE WHERE YOU CAN LEAVE YOUR PARCEL.  IF YOUR PARCEL IS NOT SIGNED FOR WE CANNOT BE RESPONSIBLE FOR ANY DAMAGES ETC.  SHOULD YOUR PARCEL BE STOLEN CREATE AND CHERISH WILL BE UNABLE TO REPLACE THE ITEM FOR YOU. 

    PLEASE NOTE THAT REMOTE AREA'S MAY TAKE LOGER TO DELIVER.  IN SOME CASES THIS CAN BE UP TO 3 DAYS AFTER DISPATCH.

    1.3  LATE DELIVERIES

    WE RELY ON 3RD PARTIES TO DELIVER OUR ITEMS SUCCESSFULLY.  HOWEVER, ON OCCASION ITEMS DO NOT MAKE IT TO THEIR DESTINATION ON TIME.  THIS CAN BE DUE TO A NUMBER OF THIGS INCLUDEING ROAD WORKS, SEVERE WEATHER ETC, WHICH ARE OUT OF OURS AND OUR COURIERS CONTROL.  AS SUCH WE CANNOT GUARANTEE THIS DELIVERY TIMES, WE CAN ONLY WORK WITH OUR COURIERS TO GET THEM TO YOU AS SOON AS POSSIBLE.

    IF A DELIVERY HAS BEEN ATTEMPTED AND YOU WERE NOT AVAILBE TO RECEIVE YOUR ITEM YOU ARE NOT ENTITLED TO A REFUND OR REPLACEMENT.

    RETURN OF GOODS

  2. WE CANNOT ACCEPT THE RETURN OF BALLOON GOODS ONCE THEY HAVE BEEN ACCEPTED BY THE CUSTOMER AND LEFT OUR PREMISES.  BALLOONS ARE NOT GUARANTEED AND CAN DETERIORATE WITH ENVIRONMENTAL CONDITIONS.  IT IS YOUR RESPOBSILITY TO MAKE SURE THAT YOUR DISPLAY  IS COVERED FOR THE TIME YOU REQUIRE.  

    2.1  IN THE CASE OF DELIVERY TO A CHRISTENING, WEDDING EVENT ETC A PICTURE WILL BE TAKEN OF THE DISPLAY BEFORE WE LEAVE.  SHOULD IT BE TAMPERED WITH BY STAFF AT THE EVENT OR VENUE YOU WILL BE CHARGED ACCORDINGLY.

    BALLOONS

  3. A NON-REFUNDABLE DEPOSIT IS TO BE PAID ON BOOKING ANY BALLOON DISPLAY.

  4. CHILDREN UNDER THE AGE OF 3 SHOULD NOT BE ALLOWED TO PLAY WITH OR HOLD BALLOONS OF ANY SORT.  THIS IS FOR SAFETY REASONS DUE TO CHOKING HAZARDS.

  5. IF HIREABLE BALLOON FRAMES/EQUIPMENT ARE LEFT ON SITE, THESE WILL BE COLLECTED AT AN AGREED TIME.  IF THEY ARE NOT READY FOR COLLECTION IT WILL BE THE CLIENTS RESPONSIBILITY TO MAKE SURE THAT THEY ARE DELIVERED BACK TO CREATE AND CHERISH EVENTS AS SOON AS POSSIBLE.  IF COLLECTION IS NOT MADE ON THE AGREED DATE THE CLIENT WILL BE CHARGED INTEREST ON A DAILY BASIS OF 2% PER DAY.  IF NOT RETURNED WITHIN 30 DAYS OF AGREED COLLECTION THE CLIENT WILL BE CHARGED THE FULL REPLACEMENT RATE.

  6. PLEASE NOTE THAT CREATE AND CHERISH EVENTS CANNOT PROVIDE A GUARANTEE WITH ANY BALLOONS.  ONCE BALLOONS HAVE BEEN SET UP AND LEFT ON SITE CREATE AND CHERISH EVENTS WILL NOT BE HELD RESPONSIBLE FOR ANY CHANGE IN BALLOONS STATE AS IT CANNOT BE PROVED IF BALLOONS HAVE BEEN MISHANDLED.  PICTURES ARE ALWAYS TAKEN ONCE SETUP FINISHED.

    DECOR PAYMENT

  7. ON CONFIRMATION OF BOOKING FROM THE CLIENT CREATE AND CHERISH EVENTS WILL HOLD A DATE FOR 14 DAYS FOR ANY DEPOSIT OR PAYMENT TO BE RECEIVED.  ONCE THE 14 DAYS HAVE LAPSED THE DATE WILL BE RE-OPENED AND ANY BOOKING WILL COME ON A FIRST COME FIRST SERVE BASIS.

  8. A NON-REFUNDABLE DEPOSIT OF 50% OF THE TOTAL ORDER OF VENUE DECOR IS REQUIRED TO CONFIRM AND HOLD THE DATE OF THE WEDDING/EVENT OR BALLOON DECOR ON BOOKING.  THE DEPOSIT WILL BE DEDUCTED FROM THE FINAL BILL.  PAYMENTS CAN BE MADE BY BANK TRANSFER, CASH OR CHEQUE.

  9. A RECEIPT OF DEPOSIT PAYMENT AND FINAL BILL CAN BE SEEN BY RE-ENTERING YOUR INVOICE FOLLOWING ANY PAYMENT, THE ORIGINAL INVOICE IS THE ONLY INVOICE TO BE SENT AND YOU ARE REQUIRED TO MAKE SURE ANY FURTHER PAYMENTS ARE MADE ON TIME.  IN THE CASE OF FINAL NUMBERS, THESE MUST BE CONFIRMED A MINIMUM OF 2 WEEKS PRIOR TO THE EVENT DATE IN ORDER FOR ADJUSTMENTS TO BE MADE TO THE FINAL INVOICE. ANY INCREASE IN NUMBERS WILL BE CHARGED ACCORDINGLY AND A FURTHER BILL WILL BE SENT.  THE FINAL BALANCE IS DUE AND SHOULD HAVE CLEARED CREATE AND CHERISH EVENTS ACCOUNT A MINIMUM OF 12 DAYS BEFORE THE WEDDING/EVENT DATE.  FAILURE TO MAKE THIS PAYMENT DEADLINE MAY RESULT IN GOODS AND SERVICES NOT BEING UNDERTAKEN.  IN THE CASE OF ENTERTAINMENT THE BALANCE IS DUE ON ARRIVAL AT THE EVENT/PARTY AND SHOULD BE PAID TO THE ARTISTE IN CASH ONLY.

  10. ALL ITEMS REMAIN THE PROPERTY OF CREATE AND CHERISH EVENTS AND MUST BE RETURNED WITHIN THE TIME SPECIFIED. 

    CALL OUT CHARGES

  11. ANY CALL-OUTS TO REPAIR DECOR DAMAGE CAUSED ACCIDENTALLY OR MALICIOUSLY WILL INCUR AN ADDITIONAL CHARGE FOR TIME AT £30 PER HOUR PLUS MATERIAL COSTS.  ANY ITEM OF DECOR DEEMED BY THE DECORATOR TO BE BEYOND ECONOMIC REPAIR WILL BE REMOVED AND WILL INCUR A REPEAT CHARGE OF THE ORIGINAL INVOICED COST TO REPLACE, IF REQUIRED.

    DAMAGE

  12. ON INSPECTION OF HIRED EQUIPMENT ANY DAMAGE FOUND WILL BE INVOICED AT FULL REPLACEMENT VALUE.  ANY DELAY IN PAYMENT OF SAID INVOICE WILL INCUR INTEREST AT £10 PER DAY. 

    INSURANCE

  13. CREATE AND CHERISH EVENTS HOLD £5 MILLION PLI INSURANCE. HOWEVER, IT IS THE HIRER’S RESPONSIBILITY TO ENSURE THAT THE ITEMS HIRED ARE FULLY COVERED BY EITHER THEIR OWN INSURANCE OR THE VENUES INSURANCE WITH REGARD TO PUBLIC LIABILITY RISKS. CREATE AND CHERISH EVENTS WILL NOT BE LIABLE WITH RESPECT TO ANY CLAIMS MADE BY ANY PERSON FOR THE DEATH, PERSONAL INJURY OR DAMAGE CAUSED BY OR IN CONJUNCTION WITH THE HIRED ITEMS FROM CREATE AND CHERISH EVENTS INCLUDING FITTING SERVICES.

    CANCELLATION

  14. IN THE EVENT OF A CANCELLATION OF THE EVENT THE NON-REFUNDABLE DEPOSIT OF 50% WILL BE TAKEN/INVOICED AND RETAINED FROM THE INITIAL PAYMENT.  NO FURTHER CHARGES WILL BE APPIED AND THE CLIENT WILL NOT RECEIVE A REFUND.  IN THE CASE OF POSTPONEMENT, DEPENDING ON AVAILABILITY THERE WILL BE AN EXCEPTION.  IN THE CASE OF POSTPONEMENT, WE WILL GIVE TIME FOR THE CLIENT TO FIND ANOTHER DATE.  HOWEVER, MONIES WILL ONLY BE HELD FOR A PERIOD OF 18 MONTHS FROM CANCELLATION.

    ACCESS

  15. IT IS THE RESPONSIBILITY OF THE HIRER TO ENSURE THAT THE ROOM/AREA BEING DECORATED, TABLES BEING DECORATED ON THE DAY ARE SET UP AND READY FOR FITTING AT THE AGREED ACCESS TIME, WHICH SHOULD BE DISCUSSED PRIOR TO THE WEDDING/EVENT.  HOWEVER, CREATE AND CHERISH EVENTS WILL LIAISE WITH THE HOTEL PRECEDING THE WEDDING TO MAKE SURE THAT THE EVENT RUNS SMOOTHLY.

    SHORTAGE

  16. THE HIRER IS RESPONSIBLE FOR THE SAFE KEEPING OF ALL HIRED ITEMS FROM COLLECTION THROUGH TO RETURN TO CREATE AND CHERISH EVENTS. UPON COLLECTION/RECEIPT OF GOODS AFTER HIRE, IF ANY HIRED ITEMS ARE MISSING THEN CREATE AND CHERISH EVENTS WILL INFORM THE CLIENT WITHIN 14 DAYS.  IF THE MISSING ITEMS ARE RETURNED WITHIN 28 DAYS AFTER THE EVENT NO CHARGES WILL BE APPLIED. FAILURE TO RETURN THE MISSING ITEMS WILL RESULT IN THE FULL REPLACEMENT FEES BEING CHARGED AS PER THE REPLACEMENT PRICE.

    COLLECTION

  17. CREATE AND CHERISH EVENTS WILL COLLECT THE HIRED ITEMS THE DAY AFTER THE EVENT HAS TAKEN PLACE FROM THE EVENT LOCATION OR FROM A LOCATION THAT HAS BEEN CONFIRMED IN ADVANCE OR AT A TIME AGREED WITH THE ORGANISER. GOODS MUST BE READY AND AVAILABLE FOR COLLECTION AT THE AGREED TIME.  THIS IS USUALLY EARLY IN THE MORNING DUE TO OTHER EVENTS BEING HELD AT THE VENUE. ANY FAILED COLLECTIONS WILL BE CHARGED FOR ACCORDINGLY. 

    ENTERTAINMENT – FACE PAINTING, BALLOON MODELLING, TEMPORARY TATTOOS OR MEET AND GREET CHARACTER VISITS

  18. A DEPOSIT OF 50% IS PAYABLE ON BOOKING.  PAYMENT BEING RECEIVED IS YOUR CONFIRMATION THAT ALL DETAILS ON THE CONFIRMATION DOCUMENTATION AND INVOICE ARE CORRECT.  SHOULD TIME NOT ALLOW PAYMENT OF DEPOSIT, THE WHOLE FEE IS DUE ON ARRIVAL OF THE BOOKING UNLESS OTHERWISE AGREED IN WRITING. LATE PAYMENT WILL BE CHARGED AT £5.00 PER DAY. IN THE EVENT OF CANCELLATION BY THE CLIENT, THE ARTISTE RETAINS THE DEPOSIT OR IN A CASE OF TIME NOT ALLOWING PAYMENT THE FULL BALANCE WILL BE DUE IF THE CLIENT CANCELS A BOOKING WITH THE 12 DAYS PRIOR TO THE EVENT. IN THE EVENT OF ACCIDENT OR ILLNESS PREVENTING THE ARTISTEFROM ATTENDING, THE ARTISTE WILL CONTACT THE CLIENT AS SOON AS POSSIBLE AND RE-SCHEDULE ANOTHER SUITBALE ARTISTE OR FULL REFUND AT THE CLIENTS DISCRETION.

  19. THE ARTISTE WILL ARRIVE BEFORE THE START OF THE BOOKED TIME TO ENABLE SET UP AND BE READY TO WORK FROM THE SPECIFIED TIME. THE ARTISTE AGREES TO DRESS IN UNIFORM (IF REQUESTED) or APPROPRIATE SMART CLOTHING.

  20. THE ARTISTE RESERVES THE RIGHT TO DISPLAY/DISTRIBUTE ADVERTISING MATERIAL DURING THE BOOKING UNLESS OTHERWISE FORMALLY AGREED WITH THE CLIENT IN WRITING. ANY FUTURE BOOKING ARISING FROM ANY PERFORMANCE DIRECTLY OR OTHERWISE WILL BE NEGOTIATED BY THE ARTISTE.

  21. THE ARTIST AGREES TO BE RESPONSIBLE FOR THEIR EQUIPMENT AT ALL TIMES AND WILL HAVE CARRIED OUT A RISK ASSESMENT FOR ANY HAZARDS THE ARTISTES EQUIPMENT MAY POSE TO THE CLIENTS EMPLOYEES AND MEMBERS OF THE PUBLIC/CUSTOMERS. A COPY OF THE RISK ASSESSMENT IS AVAILABLE ON REQUEST.

  22. THE ARTISTE WILL NOT, AT ANYTIME DURING THE BOOKING, USE ANY PRODUCT THAT IS NOT FDA OR EC APPROVED/COMPLIANT SPECIFICALLY DESIGNED FOR USE ON THE FACE/SKIN. THE ARTISTE WILL DISPLAY AND ENFORCE THEIR STANDARD DISCLAIMER AT ALL TIMES. A COPY OF WHICH IS AVAILABLE ON REQUEST.

  23. THE ARTISTE IS NOT RESPONSIBLE FOR CROWD CONTROL OR QUEUE AT ANY TIME (either spectators or customers) BUT WILL BE RESPONSIBLE FOR CLOSING THE QUEUE SO THAT THEY DO NOT RUN OVER THE AGREED BOOKING TIME. ANY BOOKING EXTENSION IS ENTIRLEY AT THE ARTISTE’S DISCRETION AND WILL BE CHARGED PRO RATA (minimum of 1 hour) 

  24. THE CLIENT AGREES TO THE ARTISTE TAKING REASONABLE BREAK/S AS AND WHEN THEY ARE REQUIRED. A 20 MIN BREAK DURING A BOOKING OF 4 HOURS OR MORE IS COMPULSORY. ANY LOSS/DAMAGE TO EQUIPMENT AND/OR CONTAMINATION DURING THE BOOKING (HOWEVER CAUSED) WILL BE CHARGED TO THE CLIENTAT COST (UNDER SEPERATE INVOICE) AND BE PAYABLE WITHIN 14 DAYS.  IN THE CASE OF CHARACTER VISITS A 10 MIN BREAK IS COMPULSORY DURING EVERY HOURLY VISIT IF MORE THAN 1 HOUR.

  25. THE CLIENT WILL PROVIDE A SAFE AND WELL LIT WORK AREA, SHELTERED FROM ADVERSE ENVIROMENTAL CONDITIONS (rain, strong wind, cold, heat, dust, fumes etc).THE ARTISTE DOES NOT PROVIDE OUTDOOR SHELTER. THE ARTIST RESERVES THE RIGHT TO TERMINATE THE BOOKING IF A SUITABLE SHELTERED AREA IS NOT PROVIDED. ON TERMINATION OF THE BOOKING, THE TOTAL FEE IS DUE.

  26. THE CLIENT AGREES TO PROVIDE SUITABLE PARKING AND PAY ANY EXPENSE ARISING FROM THE USE OF SUCH PARKING OR THE LACK THEREOF. THE CLIENT WILL INFORM THE ARTIST OF ANY FORSEABLE PARKING COSTS INVOLVED PRIOR TO THE EVENT AND TO MINIMISE THE DISTANCE FROM SUITABLE PARKING. EQUIPMENT IS HEAVY AND THE CLIENTSASSISTANCE MAY BE REQUIRED OVER LONG DISTANCES, FLIGHTS OF STAIRS ETC. IT IS THE CLIENTS RESPONIBILITY TO ENSURE ACCESS TO THE VENUE IS POSSIBLE AT THE REQUIRED TIME AND CONSENT FOR THEARTISTE TO ATTEND HAS BEEN GRANTED BY THE RELEVANT PERSON.

  27. THE ARTISTE WILL NOT KNOWINGLY PAINT ANYONE UNDER THE AGE OF 3 YEARS UNDER ANY CIRCUMSTANCE.

  28. THE EVENT DATE WILL BE HELD FOR A 14 DAY PERIOD FOR THE CLIENT TO MAKE A DEPOSIT PAYMENT.  SHOULD YOU WISH TO PAY BY TRANSFER PLEASE SEE THE  BOTTOM OF THE INVOICE ALTERNATIVELY THERE SHOUDL BE A LINK ATTACHED TO THE INVOICE WHEREBY YOU PAY BY PAYPAL.  IF PAYMENT IS NOT MADE WITH 14DAYS OF IT BE SENT, CREATE AND CHERISH CANNOT GUARANTEE ANY BOOKING AND THE DATE WILL BE GIVEN ON A FIRST COME FIRST SERVE BASIS.

  29. CREATE AND CHERISH EVENTS hold their own PLI and Employers Liability insurance and CRB checks, these are available on request if appropriate.   CREATE AND CHERISH EVENTS ARE ALSO MEMBERS OF NABAS THE BALLOON ASSOCIATION.

  30. By making a deposit payment you are agreeing to be bound by these Terms and Conditions herein.  Please check all the details on your invoice.  Your invoice is what tells you what you have ordered and where the items are to be delivered to including the date of delivery. 

    PLEASE NOTE THAT WE RESERVE THE RIGHT TO AMEND OUR TERMS AND CONDITIONS AT ANY TIME.
